Selling a Car With a Loan or Lien in Ontario

Still owe money on the car you want to sell? You're not stuck. But there's a right way and a wrong way to handle it, and getting it backwards can hold up your sale for weeks.

What a Lien Actually Is

When you finance a vehicle, the lender registers a security interest against it under Ontario's Personal Property Security Act (PPSA) — that registration is the "lien." It's the lender's legal claim that says, in effect, "this vehicle is collateral until the loan is paid off." It doesn't stop you from driving the car or even from selling it — but it does mean the lender has a legal stake in it until their balance is cleared.

A lot of people assume a lien is just paperwork sitting in a filing cabinet somewhere. It isn't. It's registered and searchable, and it follows the vehicle, not you. If you sell a car with an active lien and don't deal with it properly, that lien can technically still attach to the vehicle in the new owner's hands — which is exactly why buyers (private or dealer) are cautious about financed vehicles.

How to Check If There's a Lien on Your Car

If you're not sure whether your loan is registered as a lien (most auto loans and leases are), a couple of ways to check:

  • Your loan or lease statement will usually name the lienholder — often the bank or finance company, not always the dealership you bought from.
  • A Used Vehicle Information Package (UVIP) pulled from ServiceOntario will show any registered lien against the VIN.
  • You can call your lender directly and ask for your current payout balance — the exact amount required to clear the lien as of a specific date, since interest accrues daily.

The Wrong Way: "I'll Pay It Off Once I Get the Cash"

This is the mistake that trips people up most in private sales. The plan sounds reasonable — sell the car, use the proceeds to pay off the loan — but it creates a real problem: the buyer is paying for a vehicle that legally still belongs, in part, to your lender. A cautious buyer (rightly) won't hand over full payment until the lien is actually cleared and the ownership is free and clear. That standoff is how private sales on financed vehicles fall apart, sometimes after weeks of back-and-forth.

Two Ways to Actually Do This

Option 1 — Pay it off first, yourself. Get your exact payout quote from the lender, pay the balance, wait for the lien discharge to process, then sell the car with a clean title. This works, but it means coming up with the payout amount before you have the sale proceeds in hand — not realistic for everyone.

Option 2 — Sell to a buyer who handles the payout directly. A licensed dealer buying your car can pay off your lender directly out of the sale proceeds and deduct that amount from your payout. You never have to front the payoff yourself, and the paperwork between your lender and the new owner happens as part of the transaction instead of before it.
